The events of September 11th, 2001 galvanized US and global resolve in the battle against money laundering and terrorist financing. In response to those events, the United States, numerous foreign governments as well as several prominent international organizations such as the United Nations and the World Bank have intensified their fight against money laundering. Through enhanced money-laundering prevention and detection legislation and policy guidelines, governments and international agencies have both mandated and encouraged a broad range of institutions to implement and maintain procedures and policies designed to detect and deter money laundering. The significant effect that these regulations and guiding principles have had on the international financial community is that most financial institutions, as broadly defined in legislation, now maintain a significantly heightened legal accountability for the implementation and ongoing effectiveness of an anti-money laundering compliance program.
Because every financial institution is unique and almost all institutions conduct their operating activities in accordance with internally generated policies and procedures, IPSA believes that no single Anti-Money Laundering program design is suitable for every institution or regulatory situation. Coupled with the onerous nature of the regulatory provisions governing AML compliance and the manner in which they are applied broadly by the regulators, IPSA believes that each institution needs to evaluate its AML requirements carefully and implement its AML programs in a manner that best fits that organization. In order to be truly effective, an AML program should be a reflection of an organization’s customer base, demographics, products and services, geography, regulatory history, risk profile and overall corporate culture.
